We are pleased to report that IBM and its Works Council (OR) have reached an agreement on pension transition under the Future Pensions Act (Wtp).

Are you now no longer working at IBM or Kyndryl or already receiving a pension from SPIN? We list the most important arrangements for you below.
Wtp agreements in outline
- The accrued Defined Contribution (DC) capital will not be converted to a new plan (there will be no “rafting in”). SPIN will continue to manage the accrued pensions;
- The accrued Defined Benefit (DB) pension will also not be converted to a new plan (there will be no “rafting in”). Accrued DB entitlements will remain intact, including the top-up guarantee from IBM and Kyndryl. SPIN will continue to manage and pay out accrued pensions in the current manner; this also applies to the partner’s pension.
- Current allowance schemes 1, 2 and 3 remain unchanged.
The intended effective date of the Wtp agreements is Jan. 1, 2028. More information on exactly what the agreement entails will follow later. The basis for the new agreements between IBM and the Works Council is that no one will lose out because of the Wtp.
Other agreements
In addition, IBM and the Works Council have agreed that over the next three years they will explore the possibility of you using your DC capital to also purchase a pension from SPIN.
Follow-up steps
Now that there is agreement between IBM and the Works Council, all agreements will be recorded in a transition plan. The association of pensioners and others (GBC) then has a statutory right to be heard. This means they can give their opinion on the proposed agreements. After consultation with the GBC, the transition plan will be presented to SPIN. We will assess whether we can implement the agreements made. Regulators DNB and AFM must give their approval.
