Currently, IBM and the works council are still discussing what the changes in pension rules mean for pensions at SPIN. So they have not yet reached an agreement. It is worth noting that one of the outcomes could also be that nothing changes for retirees, for example. Should there be any changes, they are not expected to be implemented until Jan. 1, 2028.
For former Kyndryl employees and pensioners, Kyndryl and the Works Council have already reached agreements. In principle, they will not convert pensions already accrued with SPIN to the new pension plan.
Negotiations between IBM and the Works Council include these important decisions:
- What will the new pension plan look like?
- When does the new pension plan go into effect?
- Do existing pensions carry over to the new scheme?
In the decision-making process, the association of pensioners (GBC), among others, has a statutory right to be heard. This means they can give their opinion on the proposed changes. Then the SPIN board will also review and have to approve the final plans.
What does this mean for you?
The failure to reach agreement has no consequences for you. For now, nothing will change in terms of your pension accrual or benefit. However, the time when we can inform you about the consequences of the new pension law for your pension at SPIN may shift.

Fortunately, we still have some time. The deadline for the new pension plan to take effect under the Future Pensions Act is Jan. 1, 2028.
