Stichting Pensioenfonds IBM Nederland collects and processes personal data. Not only to properly execute the pension agreement, but also to comply with legal and contractual obligations and to improve our services. Contractual provisions imply that we need to receive data from you and from other parties for this purpose. We process the data of (former) participants, (former) partners, orphans, pension beneficiaries, their legal representatives and affiliated employers.

We handle your data with care. We ensure that we do not collect more data than necessary and that unauthorized persons do not have access to data. We have taken appropriate technical and organizational measures to secure your personal data against theft, loss or unauthorized use. We are open and clear about what we do and make it easy for you to view and modify your data. We do not work on the basis of automated decision-making.

Depending on your situation, we may receive information about you and/or your employment from the following parties:

  • Basic Registration of Persons (BRP).
  • (Former) employer(s)
  • Employee Insurance Administration Agency (UWV).
  • Chamber of Commerce (CoC).
  • Other pension providers
  • Yourself
  • Tax Office
  • The CAK
  • A financial planner hired by you
  • Bailiffs and other judicial agencies managing claims against participants.

Why we need your information

Stichting Pensioenfonds IBM Nederland is contractually obliged to execute the pension agreement. In order to do this properly, we process your (personal) data for the following purposes:

  • Determining the amount and payment of pension entitlements and benefits
  • Calculate, record and collect premiums
  • Handling complaints, disputes or legal proceedings
  • Prevention of fraud
  • Statistical analyses
  • Adequate communication with you

Sharing with other parties

Stichting Pensioenfonds IBM Nederland shares your personal data with various other parties as necessary for the execution of the pension agreement and/or to comply with legal obligations. We enter into a processing agreement with parties who process your data on our behalf. These parties may only process your personal data for the agreed purposes and only in accordance with the law and our explicit instructions. In this way, we ensure the same level of security and confidentiality for your data. Stichting Pensioenfonds IBM Nederland remains responsible for this processing. Stichting Pensioenfonds IBM Nederland does not process your data outside the EU.

The implementation of the pension administration is done by Stichting Pensioenfonds IBM Nederland itself. For this purpose, your data are provided internally to employees of the pension fund. We also use suppliers for the development and management of the ICT systems, among other things. Since the data is stored in these ICT systems, these service providers may have access to your personal data under our supervision and responsibility. We also use the services of suppliers for sending postal items. When creating, printing and sending mail items, a supplier may possibly have (temporary) access to your personal data.

In addition to the above service providers, we may (occasionally) provide data to other service providers. All these services are aimed at performing and improving our task as pension administrator. In doing so, we do not pursue a commercial objective.

  • Accountants/actuary firms for assurance purposes
  • Pensions Ombudsman
  • Other pension providers and the pension registry foundation

How long we keep your data

Stichting Pensioenfonds IBM Nederland does not retain your personal data for longer than is strictly necessary and within the legal requirements to fulfill the purposes for which they were collected. Because we are dealing with long-term pension obligations, this can be a very long period of time. We keep the personal data necessary for the execution of the pension agreement in any case until 25 years have passed after the end of your pension entitlement. If we no longer need your data, we delete the data.

Recording phone calls

Stichting Pensioenfonds IBM Nederland may record telephone conversations. These recordings are used, among other things, for training and coaching purposes, but also for investigating suspicious assignments and transactions or for combating fraud. The recorded telephone conversations are not kept longer than necessary for the above purposes. Within the retention period, you are entitled to a playback of the telephone conversation.

View, modify or delete data

You have the right to access and modify (correct) your personal data. In certain cases, you can also ask us to restrict the processing of your personal data, erase your data or transfer your data to another so-called controller.

Withdrawal of consent

To properly administer your pension plan, we obviously need certain personal data. But this does not apply to all the data we process. You can therefore ask us to stop using your data for certain situations. For example, if you do not want us to call or e-mail you or if you have an important personal reason why you do not want us to use your data.

You may send a request for access, correction, restriction, deletion or transfer to info@spin.nl. You may also use this e-mail address to withdraw your consent to the use of your personal data. To make sure that the request is made by you, we ask you to send a copy of your ID with the request. Make sure that on this copy the passport photo and the Citizen Service Number (BSN) have been made unrecognizable. This is for the protection of your privacy. Stichting Pensioenfonds IBM Nederland will respond to your request as soon as possible, but at the latest within four weeks.

Complaint Law

If Stichting Pensioenfonds IBM Nederland does not comply with your request to inspect, correct, limit, delete or transfer your personal data, you can submit a complaint about this to the Authority for Personal Data. If your complaint is not resolved to your satisfaction, you may appeal to the courts.

Security

Stichting Pensioenfonds IBM Nederland takes the protection of your data seriously and takes appropriate measures to prevent its misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you feel that your data is nevertheless not properly secured or that there are indications of misuse, please contact us.
